This report examines the relationship between national fiscal regimes and the formality of the artisanal and small-scale gold mining (ASGM) sector. Specifically, the study attempts to determine whether and to what extent a country’s fiscal regime – the total of taxes, fees, and royalties – acts as significant factor pushing ASGM producers and exporters into informality. The report addresses the production segment of the gold supply chain from the commercialisation segment and focusses specifically on nine planetGOLD countries: Burkina Faso, Colombia, Ecuador, Guyana, Indonesia, Kenya, Mongolia, the Philippines, and Peru.
Gold With Dignity: A Review of Laws and Policies on Artisanal and Small-Scale Gold Mining (ASGM) in the Context of Human Rights-Based Approach to Formalization in the Philippines

This study is an assessment of the existing legal and policy framework in the Philippines on artisanal small-scale gold mining (ASGM) in order to determine the pathways for the formalization of the ASGM sector. The study specifically aims to: (1) Review and analyze the existing policies and legal framework governing the ASGM sector, gold trading, and illicit financial flows (IFF) in the Philippines; (2) Assess the effectiveness of the implementation of the laws and regulations governing ASGM in the two project sites, namely: Paracale, Camarines Norte and Sagada, Mountain Province; (3) Identify the gaps and barriers, both legal and non-legal, to the formalization of the sector; and (4) Provide specific recommendations on the policy issues and gaps that were identified with specific gender-responsive policy recommendations that would address the gaps and barriers in the formalization of ASGM as a sector.

Midway through its project lifespan, the planetGOLD project in Indonesia reflects on the achievement of its formalization target. Taking local situations into consideration, the project reflects that supporting the formalization of 60 mining groups in the 6 project locations within 5 years may not be easy. The project is therefore opting to re-route its supports based on the outputs resulting from each formalization target.
